Terms and Conditions of RNS Careers
Introduction
These terms and conditions govern the provision of headhunting and recruitment services by RNS Careers (the “Agency”) to its clients. The Agency specializes in identifying, evaluating, and placing candidates in various roles across multiple industries.
Services Rendered
The Agency offers talent acquisition services, focusing on both executive search and general recruitment. Services include sourcing candidates, conducting interviews, and providing recommendations to clients based on job specifications and candidate qualifications.
Right of Referral
The Agency’s service charge is earned when an individual referred by the Agency accepts an offer of employment by the client or its affiliates within one year from the date of the last referral or discussion about the individual.
Recruitment for Various Positions
If a candidate referred by the Agency is hired for a position different from the one they were initially presented for, within the one-year referral period, a full-service charge is still applicable.
Fee Structure
The Agency’s service charge is based on a percentage of the new hire’s base salary at the time of hire or a percentage of the new hire’s estimated total first-year compensation.
Payment Terms
The service charge is due and payable when earned. Full payment of the fee is due within 15 calendar days of the candidate’s start date.
Guarantee Period
The Agency guarantees placements for a specific calendar day period after employment commences, on a pro-rated basis. We will help the client hire a replacement candidate for terminations within the first 30 days of employment.
Candidate Confidentiality
The Agency maintains confidentiality of applicant information, particularly in cases where candidates are currently employed, to prevent companies from identifying candidates outside of the Agency’s recruitment process.
Probationary Period Handling
If a candidate leaves during the probationary period for performance reasons, the Agency will either reimburse the fee or find a suitable replacement within a reasonable time. The terms for reimbursement or replacement are detailed in the individual recruitment agreement.
Non-Solicitation
A recruitment agreement will define a period during which a company cannot contact candidates introduced by the Agency unless they pay the recruitment agency fee. This period is determined based on the nature and seniority of the position.
Independent Hiring
If a client hires a candidate independently of the Agency or through a different agency, no recruitment fee is due to the Agency.
Recruitment Fee Considerations
The recruitment fee is correlated with the effort involved in sourcing candidates, including reviewing CVs and profiles, and engaging with candidates. The fee reflects the time and energy saved for the employer in sourcing suitable candidates.
Prohibited Terms
The recruitment agency agreement does not include terms that are overreaching or unfair, such as seeking payment for unsuccessful introductions. Restriction periods are reasonable and not excessively long, as to not harm the interests of both candidates and employers.
Modifications and Governing Law
These terms and conditions may be modified by the Agency with proper notice. The agreement and any disputes arising from it are governed by the laws of the jurisdiction in Bangladesh.
